Terms and Conditions

This is a contract between you (hereinafter “Client”) and Kristy Morganti dba Luxe Travel by Kristy, Vacations by Kristy, and Vacations for ​You, LLC in affiliation with 101 Vacations Travel Agency (hereinafter “Travel Agent”) . Before we make any arrangements or bookings for ​your trip we require that you review and acknowledge that you have read, understand, and agree to the Terms & Conditions:


Travel Documentation: Client assumes full responsibility for checking, verifying and obtaining all necessary travel documentation for ​entry into the destinations in your itinerary, including, but not limited to passports, visas, inoculation certificates or other entry ​requirements. Passports must be valid for at least six (6) months after your scheduled return. Some countries require that your passport ​have two (2) to four (4) blank visa/stamp pages. When traveling domestically or internationally, it is recommended that each traveler ​carry at least two (2) forms of acceptable identification. Travel documentation requirements are subject to change and changes or ​updates may not be reflected in this paragraph. It us up to the Client to check and comply with current requirements. Please consult ​www.travel.state.gov for more information and to verify that each traveler in your party has the necessary documentation. Please check ​any documentation sent to you by Travel Agent for accuracy, verifying name, date, and travel arrangement if applicable. The first, middle ​and last name, date of birth and gender of each passenger provided to the Travel Agent for booking purposes must be exactly as it ​appears on the traveler’s identification that will be used while traveling – no exceptions.


Vaccinations: Client assumes full responsibility to ensure that all travelers have the proper vaccinations for the destinations in the ​itinerary prior to traveling. Please see your health provider or a medical professional for advice regarding the necessary or ​recommended vaccinations and documentations thereof. Travel Agent may provide recommendations regarding potentially necessary ​vaccinations, but in so doing does not assume any responsibility or liability for any vaccinations or failure to receive vaccinations ​required for travel.


Travel Safety: Client assumes full responsibility for checking all conditions regarding health, safety, security, political stability, strikes ​and labor or civil unrest at any and all destinations in Client’s itinerary. Travel Agent has no special knowledge regarding unsafe ​conditions, strikes, health hazards, weather hazards, or climate extremes at locations to which Client may travel. For information ​concerning possible dangers at any destination, Travel Agent recommends Client contact the Travel Warnings Section of the U.S. State ​Department at (202) 647-5225 or www.travel.state.gov. For medical information, Travel Agent recommends contacting the Centers for ​Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. The Smart Traveler Enrollment Program (STEP) is a free service provided by the ​U.S. Government to U.S. citizens who are traveling to or living in a foreign country. STEP allows you to provide information about your ​upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended. Visit ​https://step.state.gov/ for more information and to enroll.


Suppliers: Travel Agent is not the source or supplier of the travel services requested or booked and acts solely as a booking agent for ​principle supplier cruise lines, hotels, airlines, ground transportation, tour operators, destination management companies and any other ​companies providing accommodations, transportations, tours and/or other services (hereinafter “Suppliers”). Each of these Suppliers is ​an independent entity with its own management and is not subject to the control of the Travel Agent. Suppliers have their own terms, ​conditions and contracts covering cancellation policies, change fees and penalties. Client may be bound by those contracts, regardless ​of whether you receive notice of their terms. By signing below, you are consenting to those terms and conditions. Travel Agent has no ​special knowledge regarding the financial condition of the Suppliers. Travel Agent is not responsible for any acts or omissions of the ​Suppliers or their failure to provide goods or services or adhere to their own schedules and/or pricing. Client agrees that any recourse ​for such failure or event shall be with the defaulting Supplier, and not with Travel Agent. Travel Agent is not responsible for the ​cancellation of any service or refunds from Suppliers that may cease operations, whether temporarily or permanently, for any reason.


Travel Vouchers: Client understands and agrees that unused portions of travel vouchers are non-refundable.


Pricing: Price quotes are applicable to the date and time at which they are provided. Rates are always subject to change and are not ​guaranteed until booked. Quotes in foreign currency are subject to fluctuations depending on exchange rates and international credit ​card issuer fees. Travel Agent is not responsible for any price increases due to fuel surcharges, government-imposed

taxes and/or fees, or supplier-imposed increases during travel. Travel arrangements involving airline and cruise components are subject ​to supplemental price increases that may be imposed by the supplier and/or government after you have completed your purchase. ​Client hereby consents to such price increases and authorizes Client’s credit or debit card to be charged.


Scope: Only the goods and services specifically stated to be included in the offering, package or itinerary are included in the prices ​quoted by Travel Agent or Supplier and/or paid by Client. Transportation to a destination or property, shore excursions, tours, side trips, ​lodging, food and beverage, or other goods and services not specifically stated to be included will be the responsibility of the Client.

Check-Ins and Departures: It is Client’s responsibility to reconfirm all domestic and international flight details and recommended ​check-in times prior to departure. Checking in later than these recommended times may result in denied boarding. Recommended ​check-in times are subject to change without notification. It is the Traveler’s responsibility to check airport conditions or rules that ​might require earlier arrival times. This information can be found when entering your confirmation number on the airline’s website. Travel ​Agent does not assume any responsibility for any flight or schedule changes. Please note that certain countries impose departure taxes ​that require payment in cash.


Overbookings and Aircraft/Vessel Changes: Flights, tours, and cruises may be overbooked, or there may be a change in an aircraft or ​vessel. Any person denied boarding for overbooking or aircraft/vessel changes may be entitled to a compensatory payment from the ​Supplier. Travel Agent cannot guarantee against and is not liable for boarding denials, fare or accommodation downgrades, or other ​losses caused by Supplier overbookings or changes.


Travel Protection/Insurance: For your protection, we strongly recommend that you purchase trip cancellation and travel accident ​insurance. Travel Agent is not qualified or authorized to answer questions about benefits, coverage, exclusions, or conditions of any ​protection plans offered or purchased, nor to evaluate the adequacy of the existing coverage. No representation or description of the ​insurance made by Travel Agent constitutes a binding assurance or promise regarding any insurance policy offered or purchased. For ​questions or more information on any plans offered or purchased, please call the number included on the travel protection quote or plan ​provided by Travel Agent. Unless noted, travel insurance is not included in the cost of your itinerary. Information for travel insurance will




be sent to you within a reasonable time frame based on trip and components.


Credit Cards: We strongly recommend that you use a credit card when providing payment for travel services so that you can exercise ​your rights under the Fair Credit Billing Act if you do not receive the services purchased. By signing below, Client acknowledges and ​accepts that there are cancellation policies, change fees and penalties that apply to Client’s travel plans and services as set by ​Suppliers. If for any reason Client’s credit card charges are later declined, reversed or Travel Agent is unable to receive payment for the ​travel plans and services, Client acknowledges that this is a binding contract and Travel Agent will be entitled to recovery, including ​reasonable attorneys’ fees in connection with collection. If “Vacations for You, LLC” is the merchant on your credit card transaction, ​Client agrees that Travel Agent’s services consist of facilitating the sale and paying the Suppliers, and once Travel Agent provides said ​services, Client agrees not to dispute the credit card charge. If a Supplier does not provide the service or ceases operations, Client’s ​only recourse will be against the Supplier. If a Supplier goes bankrupt, Client’s only recourse will be to file a claim with the Supplier’s ​bankruptcy court.

Waiver of Liability: Travel Agent shall not be liable for any accident, injury, property damage, refund, delay, inconvenience or personal ​loss to Client or to those traveling with Client in connection with any travel services we have booked, including, but not limited to: acts of ​God, weather conditions, natural disasters, acts of government or other authorities, wars, civil disturbances, riots, strikes, epidemics or ​pandemics, acts of terrorism, breakdown in equipment, theft, delay, fuel increases, or cancellation or changes in itineraries or schedules. ​Travel Agent shall not be liable for any loss which may be caused by (1) any defaults, wrongful or negligent acts or omissions of any ​Supplier; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated or otherwise used or provided ​by the Suppliers; (3) any wrongful or negligent acts or omissions on the part of any other party not under the control of Travel Agent; ​and (4) any Supplier price drop after Client’s travel arrangements have been confirmed, paid in full, or ticketed.

Client hereby releases Travel Agent from all claims arising out of any provision covered in this agreement. Client agrees that the courts ​in Iredell County, Mooresville, NC will be the exclusive jurisdiction for all claims brought by Client or Travel Agent, and by entering into ​this Agreement Client hereby submits to the personal jurisdiction of those courts.

PLEASE READ THIS. IT CONSTITUTES PART OF YOUR CONTRACT FOR YOUR TRIP AND ANY RELATED SERVICES. PLEASE LET US KNOW ​IF YOU HAVE ANY QUESTIONS.


Booking Passenger - Lead Guest : Please thoroughly review these Terms and Conditions of 101 Vacations Travel Agency. The Booking ​Passenger(s) of this notice will be the only recipient of the booking receipt, invoice and terms, and conditions. It is the sole responsibility ​of the Booking Passenger(s) to inform all other Passengers traveling together or sharing the room of the contents of these Terms and ​Conditions. The Booking Passenger(s), by accepting this receipt and making payment to 101 Vacations Travel Agency, acknowledges that ​they have been advised of, reviewed, and hereby accept these Terms and Conditions and contract for travel related services. The ​Booking Passenger is financially responsible for all bookings in their group. You acknowledge and agree that we may change these Terms ​and Conditions from time to time and that those changes become effective immediately. You agree to be bound by the Terms and ​Conditions that are in effect at the time of your travel or cancellation, whichever applies. You agree that it is your responsibility to be ​familiar with these Terms and Conditions and to check back from time to time for any changes.


Disclaimer - Agent for Suppliers: 101 Vacations Travel Agency acts solely as an intermediary between clients and suppliers selling ​travel-related services, or in accepting reservations or bookings for services that are not directly owned or operated by this travel ​agency (such as but not limited to air and ground transportation, hotel accommodations, meals, tours, cruises). 101 Vacations Travel ​Agency is an Independent Contractor and is not an employee, agent, or representative of any of these suppliers. All suppliers are ​independent contractors and are not agents or employees or representatives of 101 Vacations Travel Agency. All travel services ​arranged by 101 Vacations Travel Agency are subject to any and all applicable laws, regulations, tariffs, and the terms and conditions of ​any agreement with a supplier. 101 Vacations Travel Agency shall not be responsible for breach of contract or any intentional or careless ​actions or omissions on part of such suppliers, which result in any loss, damage, delay, or injury to the Passenger(s). 101 Vacations Travel ​Agency shall not be responsible for failure to perform any obligation of this contract due to unforeseen circumstances or causes ​beyond our reasonable control, including but not limited to acts of God (Force Majeure), war, riot, acts of civil/military authorities, social ​or labor unrest, mechanical or construction failures or difficulties, climatic conditions, criminal acts, fire, floods, disease, epidemics, ​pandemic, labor strikes or any other actions, omissions or conditions outside the agency’s control and disclaims all responsibility or ​liability for loss, damage or injury.

Risks of Travel and Release: Passenger(s) acknowledge that travel has inherent risks, including but not limited to accidents, illness, ​injury, and loss or damage to property. By engaging our services, clients release 101 Vacations Travel Agency from any liability for such ​risks.


COVID-19 Release: The Passenger(s) expressly acknowledges that naturally occurring diseases and viruses (including, but not limited to, ​the currently widespread COVID-19) may be present and actively occurring in all environments in which your vacation will take place. ​You acknowledge the novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. You ​acknowledge that COVID-19 has made travel uncertain due to government closures and travel restrictions. COVID-19 is extremely ​contagious and is believed to spread mainly from person-to-person contact (however the exact method of spread remains unknown). ​You also understand that if you are older or have underlying conditions, you may be more prone to serious infection and death due to ​COVID-19. As a result of the highly infectious nature of this disease, federal, state, and local governments and federal and state health ​agencies recommend social distancing, wearing of PPE (including masks), and have, in many locations, prohibited the congregation of ​groups of people. You acknowledge that exposure to such viruses or disease is an inherent risk of traveling, that cannot be controlled or ​eliminated by 101 Vacations Travel Agency.


By making a booking at this time, you acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk for yourself ​and any minors traveling with you, that you or they may be exposed to or infected by COVID-19 by traveling and that such exposure or ​infection may result in personal injury, illness, permanent disability, and death. You acknowledge that due to the uncertainty of travel at ​this time, your trip may be postponed or cancelled or changes may be made to itineraries due to closures of certain sites or activities, ​for which there may be no refund. You understand that you may become sick before the trip and may not be able to travel and such ​cancellation will be subject to our cancellation terms below. You also acknowledge that you may become sick during the trip and that ​your travel plans may change, for which we will not be liable.


You understand the description of the risks due to COVID-19 is not complete and that unknown or unanticipated risks may result in ​injury, illness, death, or any other loss. You agree that having considered these risks, you, for yourself, and any minors traveling with you,

desire to book travel at this time and that you freely and voluntarily assume complete personal responsibility for the risk of exposure, ​illness, death, delay, postponement, change, and cancellation due to COVID-19, for yourself and any minors traveling with you, even if ​such injuries or losses occur in a manner that is not foreseeable at the time the booking is made. You agree that due to uncertainty ​caused by COVID 19, 101 Vacations Travel Agency has strongly encouraged the purchase of travel protection coverage including cancel ​for any reason coverage, and that should you fail to purchase travel protection coverage, 101 Vacations Travel Agency shall not be liable ​to any losses howsoever arising.


You, for yourself, and any minors traveling with you, and on behalf of my and their heirs, assigns, personal representatives and next of kin, ​HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS 101 Vacations Travel Agency, its officers, agents, and/or employees, suppliers, and ​other participants (RELEASEES), from any and all claims, demands, losses, and liability arising out of or related to any POSTPONEMENT, ​CANCELLATION, CHANGES, INJURY, DISABILITY, DEATH OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, ​and travel restrictions related to COVID- 19, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the ​fullest extent permitted by law.


Passenger(s) assumes sole responsibility for, and hereby releases 101 Vacations Travel Agency from any claims or responsibility for any ​and all damages incurred as a result of Passenger(s) failure to comply with applicable documentation requirements, including but not ​limited the requirement that all Passengers procure, and have on their person the proper travel documents at all times. 101 Vacations ​Travel Agency recommends the Passenger(s) consult with the appropriate domestic and foreign governmental agencies for the current ​document requirements. By agreeing to 101 Vacations Travel Agency Terms & Conditions, you are authorizing 101 Vacations Travel ​Agency and its Advisors to accept the passenger contract and all terms associated with your reservation as received by 101 Vacations ​Travel Agency. It is your sole responsibility to secure and/or pay for any and all visas, reciprocity fees, affidavits, immunizations, etc. that ​are required to be permitted entry into each destination. In some countries, you may be subject to entry (reciprocity) fees and/or ​departure taxes/ exit fees which will be collected at the airports upon entry/departure by local government authorities. Please note that ​entry to any country may be refused even if the required information and travel documents are complete.


Booking Accuracy and Legal Names: Passenger(s) is required to verify the accuracy of each legal passport first, middle & last names ​listed on the invoice and travel documents. It is mandatory that passenger names be identical to the names as they appear on ​passports, booking, and travel documents. Penalties associated with name changes are the sole responsibility of the Passenger(s). ​Passenger(s) is required to immediately review all aspects of their booking to verify (but not limited to): passenger names, mailing ​address, email address, telephone number, date of birth, pricing, airfare, arrival/departure airports, accommodations, and organized ​activities on your booking receipt. Please notify 101 Vacations Travel Agency immediately if any omissions and/or corrections are ​needed regarding the booking details. Passenger(s) voluntarily assumes full & sole responsibility for any and all risks and/or costs ​involved with failure to report such errors and/or omissions within 24 hours of booking.


Proof of Identity: Passenger(s) must provide valid proof of identity as required by suppliers and authorities.


Vaccination Requirements and Health Related Requirements: Passenger(s) must adhere to vaccination requirements and other ​health-related regulations imposed by destinations and transportation providers. 101 Vacations Travel Agency is not liable for any ​consequences resulting from failure to comply.

Other Foreign Entry Rules: Passenger(s) are responsible for understanding and complying with foreign entry rules, including visa ​requirements, customs regulations, and any travel advisories or restrictions.


Travel Alerts: It is each Passengers’ responsibility to educate themselves on current travel alerts by visiting http://travel.state.gov ​and/or http://wwwnc.cdc.gov/travel/. Suggested reference materials for passport, visa, health requirements as well as travel advisories:

By offering travel to any particular destination, we do not represent that travel in such destination is safe or without risk. Should you ​choose to travel to a country that has been issued a travel warning or advisory, 101 Vacations Travel Agency will not be liable for ​damages or losses that result from travel to such destinations. It is essential that you see your physician before booking your trip and ​before traveling to make sure that you have taken all necessary health precautions. Some vaccinations require more than one visit with a ​period of weeks between injections. You should visit your physician at least 6 weeks before departure.


For up-to-date medical advice we strongly recommend that you visit the Centers for Disease Control and Prevention (CDC) travelers’ ​health page: www.cdc.gov/travel or for non-US citizens, your country’s equivalent. 101 Vacations Travel Agency reserves the right to ​request health information prior to departure and to preclude any guest that in its sole discretion presents a health risk to themselves or ​others.


Payments: 101 Vacations Travel Agency holds reservations until the deposit due date if a supplier allows. If deposit/payment is not

received by 101 Vacations Travel Agency on or before the deposit due date, reservations are automatically cancelled and prices and ​availability are subject to change. Failure to remit final payments on or before the final payment date will automatically put your booking ​at risk of cancellation. Please contact us immediately, and in advance of your payment due date, if you will be unable to meet this ​obligation. Without limitation, Passenger(s) voluntarily holds 101 Vacations Travel Agency harmless for cancellation of any booking for ​either late payment or declination of a credit card. Payments are only made directly to suppliers and are never made directly to 101 ​Vacations Travel Agency. Payments are never automatic unless pre-authorized by Passenger(s). We cannot take phone payments, ​checks, bank transfers, or any other method of payment. While our suppliers do accept major credit cards including Visa, Mastercard, ​American Express, and Discover, Passenger(s) must provide to us a signed credit card charge authorization agreement. Your ​authorization is a binding agreement for us to charge your card for discussed purchases, and as such you waive any right to chargeback ​in the case of cancellation for any cause (excepting fraud), including a Force Majeure event, as defined herein, and agree to refund ​policies and procedures as outlined in these Terms and Conditions. In the event any Passenger(s) attempts to chargeback, reverse, or ​recollect a trip payment already made without the authorization of 101 Vacations Travel Agency, we reserve the right to collect all ​additional costs, fees and expenses associated with such chargeback, reversal or recollection, including, without limitation, attorney ​fees.


Pricing: Prices and availability quoted by 101 Vacations Travel Agency are not guaranteed and subject to change until the deposit is fully ​paid. Pricing and availability may change without notice.


Passenger(s) agrees that 101 Vacations Travel Agency is not responsible for any errors or omissions in any quotes, advertisements, ​including on our website, resulting in inventory, content, or pricing discrepancies nor is 101 Vacations Travel Agency responsible for any ​errors or omissions that may occur as a result of incorrect information from third parties or suppliers. Suppliers reserve the right not to ​honor any published prices that it determines were erroneous due to electronic, printing, or clerical error. You acknowledge this right ​and agree to hold 101 Vacations Travel Agency harmless for any actions or damages arising from supplier pricing. 101 Vacations Travel ​Agency reserves the right to charge Passenger(s) for any increase in taxes, fees, or surcharges (i.e. fuel). Passenger(s) acknowledge this ​right and agree to pay any such additional taxes, fees, and surcharges.

Credit Card Merchant: 101 Vacations Travel Agency may process payments through third-party credit card merchants. Passenger(s) ​agree to abide by merchant terms and conditions.


Exchange Rate Fluctuation: Passenger(s) are responsible for any exchange rate fluctuations that may affect the cost of their trip.


Price Drops: If a supplier drops the price of a trip after booking, we will try to assist you with modifying your package for the new rate if ​the supplier allows it, or canceling and rebooking depending on the cancellation policy among other variables, and a fee may apply. We ​do not guarantee any refunds or successful rebooking in the event of a price drop.


Price Increases: Passenger(s) may be required to pay additional costs resulting from price increases imposed by suppliers or changes ​in exchange rates.


Price Breakdowns: In many cases, we may be unable to provide line-by-line pricing breakdowns. We will endeavor to assist you in ​understanding the costs associated with your trip, but typically the exact rates involved are governed by confidentiality provisions in ​our Suppliers’ contracts which we do not have access to.


Revision Policies: Revisions are based on availability, subject to supplier approval, and are not guaranteed. Revisions made after final ​payment has been made are subject to Cancellation Policies.


Cancellation Policies: Passenger(s) are subject to supplier cancellation policies and may incur fees for trip cancellations. Refunds, if ​applicable, are determined by suppliers. All suppliers have their own cancellation policies, which apply to your booking. Should a ​cancellation become necessary, please inform your 101 Vacations Travel Agency advisor immediately in writing by email and request a ​written confirmation of your cancellation. If you are entitled to a refund, please note that the supplier is responsible for this refund, not ​101 Vacations Travel Agency. We are not responsible for a supplier’s failure to pay a refund.


Cancellation by a Supplier: In the event that a Supplier needs to make changes to your confirmed booking or cancel it, if we are

notified, we will notify you as soon as reasonably possible thereafter. We will work to secure alternative travel arrangements offered by ​the Supplier and liaise with you and the Supplier. If the Supplier is unable to offer agreeable alternative arrangements, we will endeavor ​to obtain and secure an alternate Supplier for your travel. However, we cannot be held responsible or liable for any further costs or ​expenses because of any changes. We are not responsible for any failure by a Supplier to provide a refund or for any Supplier ​bankruptcy, insolvency, or inability to perform.


Chargebacks: Passenger(s) agree not to initiate chargebacks against 101 Vacations Travel Agency without first attempting to resolve the ​issue directly with us. If you attempt a chargeback, reverse charge, or recollection of a payment already made without 101 Vacations ​Travel Agency’s authorization, 101 Vacations Travel Agency reserves the right to charge you additional costs, fees, and expenses ​associated with such chargeback, reverse charge, or recollection, including without limitation attorney’s fees and legal costs.


Travel Insurance: Passenger(s) are strongly encouraged to purchase travel insurance to protect against trip cancellations, interruptions, ​medical emergencies, and other unforeseen events. We have a professional responsibility to recommend the purchase of Travel ​Protection to protect both you and your vacation. Such plans, at a minimum, should cover Trip Cancellation or Interruption, Cancel for ​Any Reason, Medical Expenses, Emergency Evacuation/Repatriation, and Baggage. Travel Protection plans can help protect you in the ​event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason ​such as injury or illness before or during the trip) and can also help with reimbursement for medical emergency costs (including very ​costly medical evacuation costs), missed connections and baggage loss. While we may be able to offer some coverage through the tour ​operator/supplier we use to book your trip, there are other third-party insurance providers for you to consult with. We can provide ​assistance in obtaining suitable coverage through our partner insurance supplier as well. With that being said, this responsibility rests ​solely with each Passenger(s) and we advise you to do your research and find coverage that best fits your individual needs. 101 ​Vacations Travel Agency is limited to advising you of the need for such coverage and is not qualified to answer technical questions ​about the benefits, exclusions, and conditions of travel protection plans. 101 Vacations Travel Agency cannot evaluate the adequacy of ​the prospective insured’s existing insurance coverage. If you have any questions about your Travel Protection, please call your insurer or ​insurance agent, or broker. All claims filed with the insurance provider are reviewed, accepted, or declined at the sole decision and ​discretion of the insurance provider and not 101 Vacations Travel Agency.

Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. 101 Vacations Travel Agency cannot ​be held responsible for denied entry if any Passenger(s) is unable to provide details to authorities of insurance or denial of entry for any ​reason. Declining travel protection plan coverage could result in the loss of your travel cost and/or require more money to correct the ​situation. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs, or expenses incurred. If ​you choose to travel without adequate coverage, we will not be liable for any of your losses howsoever arising, for which travel ​protection plan coverage would otherwise have been available.


Airfare: Airline tickets are highly dynamic in pricing, highly restrictive, non-refundable, and non-transferable. Modification of passenger ​names, dates, times, routings, or departure/arrival airports is at the sole discretion of the airline and, if permitted, will likely be subject to ​a substantial change fee. Passenger(s) is responsible for any such fees.


Flight Check-Ins: Passenger(s) are responsible for checking in for flights in accordance with airline policies and procedures. Minimum ​check-in for domestic flights is 1 to1 ½ hours international flights, 2 to 3 hours. Due to heightened security measures, it is advised you ​allow extra time before scheduled departure. Failure to arrive within your airline's specified time could result in denied boarding.


Local City Taxes: Many European cities charge a local city tax, which is paid by travelers directly to the hotels. These taxes are generally ​between 2 and 5 EUR per person per night depending on the city and the category of hotel, and cannot be prepaid. This tax is the sole ​responsibility of the Passenger(s).


Force Majeure: 101 Vacations Travel Agency is not liable for any failure or delay in performance due to events beyond our control, ​including but not limited to natural disasters, acts of terrorism, government restrictions, and supplier bankruptcies.


Preexisting Medical Conditions and Persons with Disabilities: Passenger(s) with preexisting medical conditions or disabilities must ​notify 101 Vacations Travel Agency at the time of booking to ensure appropriate accommodations and assistance can be arranged. 101 ​Vacations Travel Agency makes no guarantee as to the ability of any accommodations, activity provider, or facilities advertised on its ​site to meet the special needs of disabled clients. 101 Vacations Travel Agency will offer the best recommendations possible based on

specific information provided, however, has no special knowledge regarding the suitability for disabled persons of any portion of any ​tour or activity offered. For information concerning the suitability for disabled persons for any portion of any tour or other reservation, ​contact the provider directly.


Food Allergies: If you have food allergies or any similar conditions that may cause you harm during your travel, please advise 101 ​Vacations Travel Agency in advance of booking. If any Passenger(s) has Food Allergies, each such Passenger(s) acknowledges the ​possibility of an elevated risk of reactions, delays, or disruption regarding your travel; an has sole responsibility for his or her Food ​Allergies and for performing all due diligence relating to such Food Allergies prior to, during, and following your travel. You will not pursue ​credit card “charge backs” relating to Food Allergies.


Claims Deadline and Exclusive Jurisdiction: You agree to present any claims against us within 30 days after your trip ends and to file ​suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You ​agree that the courts in Mecklenburg County, North Carolina will be the exclusive jurisdiction for all claims brought by you or us, and you ​hereby submit to the personal jurisdiction of those courts.


Client Conduct: Each Passenger(s) is expected to act responsibly and adhere to all behavior guidelines established by our local ​suppliers. We and our local suppliers reserve the right to remove you from any trip if you endanger yourself or others. In any such case, ​there will be no refund. When you book with 101 Vacations Travel Agency, you accept responsibility for any damage or loss caused by ​you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid directly at the time to the ​accommodation owner, manager, or other supplier. You must indemnify us for the full amount of any claim (also including legal costs) ​made against us. 101 Vacations Travel Agency is not responsible for any costs incurred concerning a Passenger(s) removed from a ​vacation/holiday. Passenger(s) agree not to hold 101 Vacations Travel Agency or any of its related entities liable for any actions taken ​under these terms and conditions. Baggage and personal effects are at all times the sole responsibility of the Passenger(s).


Client Communication and Contract Termination: Our primary goal is to make your travel planning experience seamless, memorable, ​and pleasant. We understand that every trip is unique, and we pledge our dedication to making your experience the best it can be.

However, while we strive to offer excellence in all areas of our services, there are instances where factors beyond our control might ​affect the planning experience. In such events, our team will do its utmost to rectify any challenges and ensure a satisfactory resolution.


Communication: We believe in open, respectful, and transparent communication with all our clients. It’s essential for both the client and ​our team to maintain a cordial relationship built on mutual respect.


Unreasonable Demands: While we always strive to accommodate the wishes and requirements of our clients, there may be times when ​certain requests cannot be met due to logistical, safety, legal, or other constraints. We ask for understanding and cooperation in these ​instances.


Abusive Communication: 101 Vacations Travel Agency maintains a zero-tolerance policy towards abusive, derogatory, or disrespectful ​communication. This includes but is not limited to verbal, written, or physical forms of abuse. Every individual, be it our advisors or our ​esteemed clients, deserves to be treated with respect.


Contract Termination: In the event of repeated unreasonable demands or any form of abusive communication, 101 Vacations Travel ​Agency reserves the right to issue a formal warning to the Passenger(s). Should the behavior persist after the warning, we reserve the ​right to terminate the contract without any further obligations. Upon termination due to the reasons mentioned above, any deposit or ​payments made will be subjected to our standard cancellation and refund policy, which may include forfeiture of part or all of the ​amount paid.


Right to Refuse Service: We reserve the right to refuse service to anyone if the interaction becomes counterproductive to the mutual ​respect and understanding required for travel planning. We truly hope that such situations never arise, and our commitment remains ​toward ensuring that your travel experience is as rewarding and stress-free as possible. Your understanding and adherence to this ​policy will enable us to provide you with the excellent service that 101 Vacations Travel Agency is renowned for.
